Terms of Service
Last updated October 28, 2026
These Terms of Service (the “Terms”) are an agreement between you and Fanout Trader LLC (“Fanout”, “we”, “us”). They cover the Fanout website at fanout.trade, the Fanout web app, the Fanout Connector browser extension and the Fanout Runner for Windows (together, the “Service”). By creating an account or using the Service, you agree to these Terms, our Privacy Policy and our Risk Disclosure. If you don’t agree, don’t use the Service.
1. Eligibility
You may use the Service only if all of the following are true:
- You are at least 18 years old and the age of majority where you live.
- You can form a binding contract, and you aren’t barred from using the Service under any applicable law.
- You aren’t located in, or a resident of, a country or region where the Service or the trading venues you connect are prohibited, and you aren’t on any government sanctions list.
- You have your own accounts with each prop firm or venue you connect, and their terms allow you to hold them.
Access is currently by invitation. We may decide who receives an invite and may limit or close access during the invite period.
2. Your own accounts only
Fanout is for trading your own accounts. Every account you connect must be registered in your name and controlled by you. One Fanout account is for one person. Keep your password and invite code private, and tell us at support@fanout.trade if you think someone else has used your account.
You are responsible for everything done through your Fanout account, your browser and any computer running the Fanout Connector or Fanout Runner on your behalf.
3. Prohibited use
You must not:
- Operate, manage or trade accounts that belong to anyone else, including family, friends or clients, or let anyone else trade through your Fanout account.
- Offer signals, trade copying, account management or any paid trading service to others using Fanout.
- Share, sell, rent or resell access to the Service.
- Use the Service for market manipulation, coordinated trading with other people, latency or pricing exploits, or any strategy a venue or prop firm prohibits.
- Interfere with, overload, probe or attack the Service or any venue’s systems, or try to get around rate limits, access controls or the invite system.
- Copy, modify, decompile or reverse engineer the Service, except where the law allows it despite this restriction.
- Use the Service in breach of any law, regulation or third party’s rights.
4. No investment advice; what Fanout is not
Fanout is software. It sends the orders you choose to the accounts you choose. It does not decide what, when or how much to trade, and it does not originate, recommend or copy anyone else’s trades.
Fanout is not a broker, dealer, exchange, futures commission merchant, introducing broker, commodity trading advisor (CTA), commodity pool operator, investment adviser or prop firm. Nothing in the Service, on our website or in our communications is investment, trading, financial, legal or tax advice, or an offer or solicitation to buy or sell anything. Fanout never holds your funds, never takes deposits and never processes withdrawals or payouts.
5. Prop-firm and venue rules are your responsibility
Each prop firm and venue (for example Vest Capital and Breakout) sets its own terms and rules. Those rules may restrict automated trading, copied trading, trading the same direction across accounts, or using third-party tools, and a firm may close accounts or withhold payouts at its discretion. Reading, understanding and following those rules is your responsibility.
Fanout shows information such as drawdown and daily-loss room, and it warns you when an order could exceed a limit. These warnings are a convenience. They may be incomplete, stale or wrong, and Fanout never blocks an order or skips an account because of them. You decide what to send.
Fanout is not affiliated with, endorsed by or sponsored by Vest, Breakout or any other prop firm or venue. All trademarks belong to their owners.
6. Connecting your accounts
To connect a venue, you sign in to it yourself in your own browser and pair the Fanout Connector (and, optionally, the Fanout Runner). Fanout never asks for or sees your venue password. By connecting, you authorize Fanout to use the session data described in our Privacy Policy to read your accounts and to relay the orders you place. You can disconnect at any time from the app, and you can remove the Connector or Runner from your devices.
You are responsible for keeping your computer, browser and venue logins secure. Orders run from your own browser or PC, so they stop when that machine is off, asleep, offline or signed out of the venue.
7. Orders, execution and outages
Trading through Fanout depends on your connection, your devices, the venues and our servers. In particular:
- Orders may fail, be rejected, lag, fill at a different price than you expected, or fill only in part. Each account receives its own order, so the same trade can fill on some accounts and fail on others.
- Venues and prop firms may be slow, unavailable, change their systems without notice, or reject orders for their own reasons.
- Prices, balances, positions and limits shown in Fanout can be delayed or differ from the venue. The venue’s own records are the record of what happened.
- Fanout sends each order once and never resends it automatically. If an account’s result is uncertain, Fanout holds further orders on that account until you reconcile it.
You are responsible for checking each account at the venue and managing your positions, including when Fanout is unavailable. See the Risk Disclosure.
8. Subscriptions, founding pricing, cancellation and refunds
The Service is free during the invite period. This section applies when paid plans are offered. We will tell you the price and terms before you are charged, and you will not be charged without agreeing to a paid plan.
- Plans. Starter is $29 per month or $279 per year, for up to 10 trading accounts (Vest and Breakout combined). Pro is $59 per month or $566 per year, for unlimited accounts subject to a fair use limit of 50. Prices are in US dollars and exclude any applicable taxes. Payments are processed by Stripe.
- Founding pricing. The first 100 founding members get Pro free for 60 days (a card is required at checkout), then Pro at $39 per month. That price stays locked while your subscription remains active without a break. If you cancel or your payment lapses, the founding price ends and current prices apply if you subscribe again.
- Renewal. Paid plans renew automatically at the end of each billing period until you cancel. We will remind you before a free period ends and before a yearly plan renews where the law requires it.
- Cancellation. You can cancel at any time in the app or by emailing support@fanout.trade. Cancellation takes effect at the end of the current billing period, and you keep access until then.
- Refunds. Except where the law requires otherwise, payments are non-refundable and we don’t give refunds or credits for partial periods or unused time. If you are charged in error, tell us within 30 days and we will fix it.
- Price changes. We may change prices for future periods. We will give you at least 30 days’ notice, and you can cancel before the change takes effect.
9. Changes to the Service
The Service is under active development. We may add, change or remove features, supported venues or platforms at any time. A venue may also change its systems in ways that stop Fanout from working with it, temporarily or permanently.
10. Our software and your content
We own the Service and all rights in it. Subject to these Terms, we give you a personal, revocable, non-exclusive, non-transferable licence to use it for trading your own accounts. You keep ownership of the notes, tags and settings you create. You give us permission to store and process them only to run the Service for you.
If you send us feedback or ideas, we may use them without any obligation to you.
11. Third-party services
The Service works with services we don’t control, including the venues you connect, your browser and operating system, and our hosting provider. Their terms and privacy policies apply to your use of them, and we aren’t responsible for their availability, accuracy or conduct.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DON’T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, THAT ORDERS WILL BE SENT, FILLED OR FILLED AT ANY PRICE, OR THAT ANY INFORMATION SHOWN IS ACCURATE OR CURRENT.
13. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, FANOUT AND ITS OWNERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, TRADING LOSSES, LOST PAYOUTS, EVALUATION OR SUBSCRIPTION FEES PAID TO THIRD PARTIES, CLOSED OR FAILED ACCOUNTS, OR LOST DATA, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND US$100.
Some jurisdictions don’t allow some of these limits, so they may not all apply to you.
14. Indemnity
You agree to defend, indemnify and hold harmless Fanout and its owners, employees and suppliers from any claims, losses, liabilities and expenses (including reasonable legal fees) arising from your use of the Service, your trading, your breach of these Terms, or your breach of any law or of any venue’s or prop firm’s terms.
15. Suspension and termination
You can stop using the Service and delete your account at any time from the app (Delete account in the Account menu), or ask us to. We may suspend or end your access, with or without notice, if you breach these Terms, if we need to for legal or security reasons, or if we stop offering the Service. Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnity and disputes) survive it.
16. Governing law and disputes
These Terms are governed by the laws of the State of Florida and applicable US federal law, without regard to conflict-of-law rules.
Before filing a claim, please contact us at support@fanout.trade and give us 30 days to try to resolve it informally. If we can’t, any dispute will be brought only in the state courts located in Palm Beach County, Florida, or the federal courts for that county, and you and we consent to their jurisdiction and venue there. Nothing in this section stops either of us from seeking urgent relief to protect our rights, or you from using a small-claims court.
17. Changes to these Terms
We may update these Terms. We will change the “Last updated” date and, for material changes, tell you by email or in the app before they take effect. If you keep using the Service after changes take effect, you accept the updated Terms. If you don’t agree, stop using the Service and cancel any paid plan.
18. General and contact
These Terms, with the Privacy Policy and Risk Disclosure, are the whole agreement between you and us about the Service. If any part is unenforceable, the rest still applies. Our not enforcing a term is not a waiver. You may not transfer these Terms; we may transfer them as part of a merger, acquisition or sale of assets.
Questions about these Terms: support@fanout.trade. Notices: support@fanout.trade.
